  • South Sudan Social Insurance Fund (SSIF)

    The fund currently is not established, because the bill still not yet passed by the parliament. 

  • Fingerprint Collection for Workpermit Application

    All visitors are required to have their fingerprints taken with the nearest Criminal Investigation Department (CID) offices within 1 week of arrival to the country.  Fingerprints collection is also a requirement when applying for work permits.

    Below are some of the requirements for fingerprints registration. Please also consult with relevant authorities for changes/updates in the requirements

    1. Write introduction letter of the new staff member (position, background of the organization, reason why)
    2. SSRRC registration for NGOs or Certificate of incorporation for companies
    3. Tax Clearance of the NGO/Company
    4. Copy of passport
    5. Copy of the entry visa
    6. 4 passport photo size

    ** There is often a fee for fingerprints collection.

  • Severance Pay

    The Labour Act 2017 refers to severance pay as terminal benefit for employees incase of:

    1. Redundancy

      Labour Act 2017 section 77: 3 and 4 states that

      • (3)Subject to sub-section(4)below, an employee whose employment is terminated on account of redundancy, after continuous service of one year or more, shall be entitled to receive, in addition to any other entitlements due to such employee upon termination, severance pay equal to two week wages/salaries for each completed year of continuous service with the employer.
      • (4)In the event of redundancy due to the insolvency of the employer, the Insolvency Act 2011 shall govern an employee claim for wages/salaries, severance pay and other entitlements
    2. Death or insolvency of the employer, physical incapacity or unfair termination

      Labour Act 2017 section 80 states that

      1. Subject to this Act, an employer shall pay severance allowance where an employee has been in his or her continuous service for a period of six months or more and where any of the following situations apply:

      • (a)the employee is unfairly dismissed by the employer;
      • (b)the employee dies in the service of his or her employer;
      • (c)the employee terminates his or her contract because of physical incapacity;
      • (d)the contract is terminated by reason of the death or insolvency of the employer; and
      • (e)such other circumstances as the Minister may by regulations provide.

      2. No severance allowance shall be paid in circumstances where an employee:

      • (a)is summarily dismissed with justification;
      • (b)abandons his or her employment, or absconds from his or her place of work without leave for a period of more than seven days without any explanation being provided to the employer; and
      • (c)contract which is terminated is a probationary contract.

      3. Calculation of severance pay shall be negotiable between the employer and the employees or the trade union that represents them.

  • Application for Work Permits

    A work permit is a legal document that allows a foreigner to legally streamline his or her employment/work status in the Republic of South Sudan. It is issued by the National Ministry of Labor (Department of Alien Employment). Procedures for processing a work permit are as follow;

    Below are some of the requirements for work permit applications. 

    • Alien should apply to the ministry for issuance of work permit
    • An application form is issued for the alien to fill (cost of application) form is $ 100. The applicant should be in possession of a valid passport and not expire during the year of application.
    • The application contains particulars pertaining to the alien and should be filled completely
    • It is also required that while submitting the field application for the following requirement must be attached depending on the category of occupation of the Alien :-
    • Institution /Business Letter head application
    • Two passport size Photos ( With White Background )
    • Valid passport copy
    • Entry Visa
    • Smart Card color copy (Renewals)
    • Curriculum vitae
    • Academic Certificates
    • Certificate of Incorporation /Registration Certificate
    • Institution/Business Tax Identification Certificate
    • Trade License and Operation License
    • Memorandum of understanding ( First and Last Page)
    • Contract Document
    • CID Clearance Certificate
    • Interpol Certificate
    • NGO Operation License
    • RRC Clearance /Recommendation Letter
    •  USAID Document
    • Oil and gas service companies registration
    • Approval From the Ministry of Health
    • Bank operation License
    • Security Operation Permit
    • Religious Certificate
    • This is then reviewed and checked by inspectors and the data provided is entered into the system for processing
    • Once processing, a payment voucher is produced for the alien to pay the required work permit fee to the prescribed bank account for non-oil revenue
    • One payment is done, the bank issues receipt therefor which serves as proof for payment

    On presentation of the bank receipt, the inspectors make the final verification and a work permit smart card is issued to the alien with a validith of one year from the date of issuance

    NOTE: All medical personnel/staff MUST get approvals from the Ministry of Health (MoH) before their work permits can be processed. This process takes one to two months. MOH often requires applicants Yellow Fever card and Job description / Contract..

  • Alien's Registration

    Passport and Immigration Act 2011 Chapter VI, section 25 on registration of aliens states that:

    1. After entering South Sudan an alien shall within three days report to the nearest Competent Authority to register his or her presence in South Sudan in accordance with the regulations.
    2. A hotel, lodge or guest house in South Sudan shall be required to keep a register of the arrival and departure of any alien guest as may be prescribed by the regulations.
    3. A person or body that employs an alien shall notify the relevant Competent Authority of such employment within three days from the date of employment of the alien, and shall on the termination of employment, forward a declaration to that effect within forty eight hours from the date of such termination.

    Alien registration requirements include:

    The NGO Recruitment Guidelines is a Ministry of Labour (MOL) guidance document that provides practical steps and requirements for recruitment of workers in the NGO Sector.

    The guidelines provide NGOs and relevant government Institutions with detailed guidance on how to conduct recruitment process based on legal principles as well as NGO principles. The guidelines are to help all those involved and concerned with NGOs, National and State Ministries and relevant government institutions.
