Zero Draft of Labour Regulations 2022

Zero Draft of Labour Regulation 2022. The Ministry of Labour with support of the Legal Consultant Jonny Saverio is conscripting labour regulations and is at the stage of zero draft for the year 2022. It is a legal framework aims to establish minimum conditions of employment, labour relations, labour institution, dispute resolution and provision for safety and health at workplace in accordance with the constitution of the Republic of South Sudan, and labour Act 2017. 
The development of the document is to fulfil the rest of the mandate derived from labour Act 2017 to regulate the private sectors. The zero draft of labour regulations was presented to the senior leadership of the Ministry of Labour recently by the Legal Consultant Jonny Saverio. During the presentation in the meeting hall, the Lead Consultant Johnny Saverio assured the leadership in the Ministry of Labour that the process has started and is progressing well. “After finishing this stage, the draft regulations will be presented to the tripartite body for the reviews before ascending it to the Ministry of Justices for the final blessing”. The legal consultant Jonny narrated. 
He added that the private sector through the NGOs Forum they have validated it and all their inputs were collected and were in place. “This is a legal framework document once the Ministry of Justice endorse the draft, other process will be finalized by the Ministry of Labour since the stakeholders have cleared there parts and this will be launched next year as ‘Labour Regulation Act 2022’ ”.  
On his part the Hon. Minister of Labour, James Hoth Mai appreciated the legal consultant said; “We thank you for hard work that you have done, which has taken nearly one year to complete the whole process, and we have noted with concern that most of the things the Ministry expected were all put in place”.  
The Minister of Labour Hon. James Hoth Mai and his Undersecretary, Mary Hillary Wani together with the 5 Directors Generals, Legal Advisor in the Ministry of Labour and other from the directorates have seconded the move towards the establishment of the labour regulations. The technical analysis of the bill, in the light of the aforesaid standard Labour Regulations and the best practices, highlights some positive aspects and allows the identification of some parts that need to be further improved in order to better align it with the aforementioned standards and best practices of Labour regulations of rules set forth in the Republic of South Sudan.
The document also included news things that shall be follow in the implementations, some of which include; any alien coming into the country has to get the work permit before the entry, the bill also give clear definitions of the key words related to labour  issues. Establishment of employment exchange where the ministry has to issue special directives, guidelines and regulation for the establishment of the employment exchange where the employment agency shall be issued with certificate of operation. 
In addition, in order to improve clarity and consistency with the labour Act 2017, the draft gives some terms and key issues in the document be changed and some others need to be introduced with all their real meaning of the terminology and/or defined in order to improve terminology consistency and to better align the typology and nature of this bill of labour regulations with the provisions of labour act 2017.
